Evaluation of the Papua Special Autonomy Law needs to be included in the 2021 Priority Prolegnas




Yorrys Raweyai (Member of the Indonesian Regional Representatives Council) supports the evaluation of the Papua Special Autonomy (Otsus) Law. Because, according to him, many articles in the Special Autonomy Law have not been implemented properly.

"Why does it need to be evaluated? Because there are many articles in the Law, there are 79 articles (which) have not been implemented properly which are outlined in the Law, ”said Yorrys.

Yorrys said the Papua Special Autonomy Law could be evaluated by including the revision of the Papua Special Autonomy Law in the 2021 Priority Prolegnas.

According to Yorrys, there are two issues that could be revised in the Papua Special Autonomy Law, namely those related to finance and expansion.

"In the future we have entered the government's surpres to the DPD and DPR regarding the revision of the Special Autonomy Law, only 3 articles on finance, articles 76-77 concerning expansion," he said.

Furthermore, Yorrys asked the government to focus on revising the Papua Special Autonomy Law considering that the Law is lex specialis so that it cannot be hampered by other regulations such as a Ministerial Regulation (Permen).

"Don't forget that the Special Autonomy Law has lex specialis. The most important thing is that this lex specialis can run in accordance with the mandate of the law. There can be no Ministerial Regulation, then there is a new law," he concluded.
