3 Suspects of Corruption of the Kingmi Mile Church 32 Timika Officially Announced, One Suspect is Detained at the KPK Detention Center
The Corruption Eradication Commission (KPK) has officially announced the names of 3 suspects in the corruption of the Kingmi Mile 32 Church in Timika.
KPK spokesman Ali Fikri told the media crew on Thursday (8/9) that the KPK conducted an investigation into the alleged corruption of the Kingmi Mile 32 Timika church and found sufficient preliminary evidence, the KPK stepped up to investigate on behalf of the suspect, as follows.
First, EO (Eltinus Omaleng), the Regent of Mimika Regency for the 2014-2019 period and the 2019-2024 period. Second, MS (Marthen Sawy), Head of the Welfare Section of the Mimika Regency Secretariat/Commitment Making Officer. Third, TA (Teguh Anggara), Private / Director of PT WM (Waringin Megah).
Ali Fikri explained the chronology of the arrests, on Wednesday (7/9), the KPK Investigation Team visited Suspect EO who was in a hotel in Jayapura City. The KPK Investigative Team then arrested Suspect EO.
This arrest was made in order to speed up the investigation process because during the investigation of this case, the suspect was considered uncooperative.
"The suspect EO and his legal counsel were then taken and secured at the Papua Police Mobile Brigade Headquarters for examination as a suspect as well as detention and today (8/9) the person concerned has been taken to Jakarta to the KPK's Red and White Building," he said.
It was stated that for the purposes of the investigation, the Investigative Team detained Tsk EO for the first 20 days from September 8, 2022 to September 27, 2022 at the KPK Detention Center at Pomdam Jaya Guntur.
"We will immediately schedule the summons for the other suspects and we hope that the suspects will cooperate in responding to the summons of the KPK Investigation Team whose letters we will send soon," he said.
As for the construction of the case, it is suspected that a series of unlawful acts occurred as follows.
Around 2013, the EO who works as a contractor and commissioner of PT NKJ
(Nemang Kawi Jaya) wants to build a place of worship in the form of the Kingmi Church in Mimika Regency with a value of Rp126 billion.
In 2014, EO was elected to be the Regent of Mimika Regency for the period 2014 to 2019 and then issued a policy, one of which was to budget the grant for the construction of the Kingmi Mile 32 Church to the Waartsing Foundation.
Then the Mimika Regency Regional Government Budget Team (TAPD) as ordered by the EO included the grant budget and the construction of the Kingmi Mile 32 church of IDR 65 billion into the 2014 Mimika regency government budget.
The EO, who is still the commissioner of PT NKJ, then built and prepared the concrete production equipment which is right in front of the location where the Kingmi Mile 32 Church will be built.
Continuing in 2015, to speed up the development process, EO then offered this project to TA with an agreement to share a fee of 10% of the project value where EO got 7% and TA 3%.
In addition, so that the auction process can be conditioned, the EO appointed MS as a Commitment Making Officer even though he did not have competence in the field of building construction.
The EO also ordered MS to win TA as the winner of the project even though the auction activities have not been announced.
After the auction process was conditioned, MS and TA signed a contract for the construction of the Kingmi Mile 32 Church with a contract value of Rp 46 billion.
For the implementation of the work, TA then subcontracted the entire construction work of the Kingmi Mile 32 building to several different companies, one of which was PT KPPN (Kuala Persada Papua Nusantara) without a contract agreement with the Mimika Regency Government, but this was known by the EO.
PT KPPN then used and leased PT NKJ's equipment where the EO still served as Commissioner.
Along the way, the progress of the construction of the Kingmil Mile 32 Church was not in accordance with the completion period as stated in the contract, including the lack of work volume, even though the payment for the work had been made.
All the actions of the suspects are contrary to the provisions of Presidential Regulation no. 54 of 2010 concerning the procurement of government goods and services.
As a result of the actions of the suspects, it resulted in state financial losses of at least around Rp. 21.6 billion from the contract value of Rp. 46 billion.
From this project, it is suspected that EO also received money in the amount of around Rp. 4.4 billion.
For their actions, the suspects are suspected of violating Article 2 paragraph (1) or Article 3 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crimes. Article 55 paragraph (1) of the 1st Criminal Code.
