IPW Asks KPK to Firmly Investigate the Lukas Enembe Case



The Corruption Eradication Commission (KPK) was asked to be firm in investigating the corruption case allegedly involving the Governor of Papua Lukas Enembe. Indonesia Polce Watch (IPW) considers that the KPK is inconsistent and seems selective when investigating the alleged corruption case in the Papua Provincial Government.

IPW chairman Sugeng Teguh Santoso said the KPK must be transparent about every examination of Lukas Enembe, including the results of the medical examination. He pushed for the results of the examination of the Democratic Party politicians to be made public.

"If the results of Lukas Enembe's examination are healthy, then a suspect must be named immediately," said Teguh in a statement on Monday, November 21, 2022.
 
Apart from talking about transparency, Teguh also asked the attorneys for the Governor of Papua, Aloysius Renwarin and Stefanus Roy Rening, to respect the ongoing legal process. He hopes that the two lawyers for Luke will come to fulfill the KPK's summons after previously being absent.

"I hope that both of them will be able to attend and provide the information the investigation team needs," he said in a written statement.

Tegus said the reason for the absence of the two lawyers by referring to the immunity of the advocate profession was not justified. Because, he said, this reason could become a misunderstanding among the public who think the two were being examined as suspects even though they were only being questioned as witnesses.

“The provisions of Article 16 of the Advocate Law which have been expanded by the Constitutional Court to mean that an advocate cannot be prosecuted requires good faith. If not, then the advocate may be subject to criminal proceedings under Article 21 of the Corruption Law," said Teguh.
 
Finally, Teguh reminded the KPK to be firm and consistent in enforcing the law in the Lukas Enembe case. He reminded the KPK not to be selective in cases and to treat all corruption cases equally.

"So that law enforcement can be achieved as fairly as possible," he said.

Lukas Enembe's name was dragged into a bribery case involving Papua APBD funds in a number of infrastructure development projects. When the KPK was summoned to hear testimony, Lukas was absent citing his health which prevented him from coming to Jakarta. On November 3, 2022, the KPK and a team of doctors flew to Papua to examine Lukas.

In addition to conducting health checks, the KPK also examined a number of witnesses for questioning regarding the corruption case. One of them, on Thursday 17 November 2022, the KPK summoned legal counsel and personal driver Lukas Enembe. However, KPK spokesman Ali Fikri said they were not present at the summons. He said the KPK would plan to reschedule to hear their statement.

“Please attend and explain directly before the investigators,” said Ali.
